Terms of Service

These terms are the agreement between you and Lilly021 d.o.o. for the use of Vigil. By creating an account or using the service you accept them.

1. Who we are

Vigil ("the service") is operated by Lilly021 d.o.o., a company registered in Novi Sad, Serbia ("Vigil", "we", "us"). These Terms of Service ("Terms") govern your access to and use of the Vigil website, dashboard, API and related services.

By registering for an account, or by accessing or using the service, you agree to be bound by these Terms. If you are entering into these Terms on behalf of a company or other legal entity, you represent that you have authority to bind that entity.

2. The service

Vigil is a client-project health and monitoring platform for agencies. It runs configurable checks against websites, APIs and mail domains you designate ("monitored units") and reports on their availability, security posture and configuration.

We may add, change or remove features over time. We will not materially reduce the core functionality of a paid plan during a billing period you have already paid for.

3. Accounts and eligibility

You are responsible for:

  • Maintaining the confidentiality of your account credentials and any API keys.
  • All activity that occurs under your account.
  • Ensuring the information you provide to us is accurate and kept up to date.

You must be at least 18 years old and able to form a binding contract to use the service.

4. Authorized use of monitoring

Some Vigil checks are intrusive by nature — they probe security headers, look for exposed secrets, scan open ports, or otherwise actively test a target. You may only point Vigil at domains, hosts and systems that you own or are contractually authorized to monitor and test on behalf of a client.

You are solely responsible for obtaining that authorization. Running intrusive checks against systems you are not authorized to test may be unlawful, and doing so is a material breach of these Terms.

5. Acceptable use

You agree not to:

  • Use the service to conduct unauthorized security testing or attacks against third parties.
  • Attempt to disrupt, overload, reverse-engineer or gain unauthorized access to the service or its infrastructure.
  • Resell or provide the service to third parties except as expressly permitted by your plan.
  • Use the service in violation of any applicable law or the rights of others.

6. Secrets and your data

Credentials and secrets you provide (for example, to authenticate a synthetic check) are stored encrypted and are referenced by the service rather than exposed. We never return secrets through the API, write them into monitoring results or alerts, or otherwise disclose them in cleartext. You remain the owner of the data and credentials you upload.

Our handling of personal data is described in our Privacy Policy, which forms part of these Terms.

7. Fees and payment

Paid plans are billed in advance on a recurring monthly or annual basis. Payments are processed by our reseller and Merchant of Record, Paddle(Paddle.com Market Ltd), who handles billing, invoicing and applicable taxes. Your purchase is therefore also subject to Paddle's buyer terms.

Unless stated otherwise, fees are exclusive of taxes, which will be added where required. Refunds are governed by our Refund Policy.

8. Cancellation

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period; you retain access until then. We may suspend or terminate accounts that breach these Terms.

9. Service availability

We work hard to keep Vigil available and accurate, but the service is provided on an "as is" and "as available" basis. Monitoring results are provided for informational purposes and may contain false positives or miss issues; you should not rely on them as the sole safeguard for any system.

10. Limitation of liability

To the maximum extent permitted by law, Vigil will not be liable for any indirect, incidental or consequential damages, or for loss of profits, data or goodwill. Our total aggregate liability arising out of or relating to the service is limited to the amount you paid us in the twelve months preceding the event giving rise to the claim.

11. Changes to these Terms

We may update these Terms from time to time. If we make material changes we will notify you by email or through the service. Continued use after changes take effect constitutes acceptance of the revised Terms.
